Mahindra BE 6E trademark violation: IndiGo files trademark infringement case against Mahindra Electric

IndiGo, a major Indian airline, has taken legal action against Mahindra Electric Automobile Limited. The case relates to trademark infringement in which Mahindra is using the “6E” identifier in its upcoming electric vehicle Mahindra BE 6E. The case has been filed in the Delhi High Court and is scheduled to be heard on 9 December 2024. This morning, Justice Amit Bansal reviewed the case but recused himself from the case.

Mahindra said in its statement: “Mahindra revealed its electric origin SUVs BE 6e and XEV 9e on 26 November 2024. Mahindra has applied for ‘BE 6e’ trademark registration under class 12 (vehicles), which is part of its electric-origin SUV portfolio.

In our view, there is no conflict as Mahindra’s mark is “BE 6e” and not the standalone “6E”. This is fundamentally different from IndiGo’s “6E”, which represents an airline, so there is no risk of confusion. Its distinct styling also further emphasizes its uniqueness.”

Mahindra also said that it has listened carefully to the concerns of InterGlobe Aviation Limited and it was not its intention to infringe their goodwill. Hence, it is in discussions to find an amicable solution between the two parties.

Mahindra BE 6E trademark violation: Previous record of IndiGo 6E

IndiGo, a leading airline of India, uses the “6E” call sign in its services, which includes 6E Prime and 6E Flex. IndiGo registered the “6E Link” trademark in 2015 to protect its brand.

Now IndiGo is filing a case against Mahindra Electric, in which they say that the use of “6E” in Mahindra BE 6E electric vehicle infringes their trademark. IndiGo has filed a petition in the Intellectual Property (IP) division of Delhi High Court.
